UTILISATION <\/b><b style=\"font-size: 1rem;\">D<\/b><b style=\"font-size: 1rem;\">U VEHICULE<\/b><\/p>\n<p>Seuls les individus sp\u00e9cifi\u00e9s dans le contrat de location ont la permission de conduire le v\u00e9hicule d\u00e9sign\u00e9 et sont couverts par notre assurance. Le pr\u00eat du volant \u00e0 une personne non identifi\u00e9e dans le contrat de location est strictement interdit sous peine d&rsquo;\u00eatre exclu de la garantie d&rsquo;assurance et donc en \u00e9tat de non assurance. Le locataire se porte garant, \u00e0 n&rsquo;utiliser le v\u00e9hicule que pour ses besoins personnels, \u00e0 ne participer \u00e0 aucune comp\u00e9tition, \u00e0 ne pas utiliser le v\u00e9hicule \u00e0 des fins illicites ou \u00e0 des transports de marchandises, \u00e0 ne pas propulser ou remorquer tout v\u00e9hicule ou remorque, \u00e0 ne pas transporter de personnes \u00e0 titre on\u00e9reux, \u00e0 ne pas solliciter directement des documents douaniers, \u00e0 ne pas surcharger le v\u00e9hicule lou\u00e9 en transportant un nombre de passagers sup\u00e9rieur \u00e0 celui indiqu\u00e9 sur la carte grise, \u00e0 ne pas utiliser le v\u00e9hicule ailleurs que sur l&rsquo;\u00eele de Tahiti ou sur l&rsquo;\u00eele de Moorea, \u00e0 ne pas utiliser le v\u00e9hicule sur les pistes.<\/p>\n<p><b>ART 2 &#8211; ETAT <\/b><b>D<\/b><b>U VEHICULE<\/b><\/p>\n<p>Le v\u00e9hicule est livr\u00e9 en parfait \u00e9tat de marche et de propret\u00e9. Il doit etre rendu dans le m\u00eame \u00e9tat de propret\u00e9, \u00e0 d\u00e9faut, le locataire devra acquitter le montant de ces nettoyages ou remises en \u00e9tat. Les &nbsp;pneus sont en bon \u00e9tat, sans coupures. En cas de d\u00e9t\u00e9rioration de l&rsquo;un d&rsquo;eux pour une cause autre que l&rsquo;usure normale, le locataire s&rsquo;engage \u00e0 le remplacer imm\u00e9diatement par un pneu de m\u00eame dimension.<\/p>\n<p><b>ART.3 DUREE. PROLONGATION<\/b><\/p>\n<p>La location du v\u00e9hicule est conclue pour une dur\u00e9e d\u00e9termin\u00e9e express\u00e9ment stipul\u00e9e au contrat. Sa prolongation ne peut valablement intervenir que par voie d\u2019avenant sign\u00e9 entre le locataire et PACIFICA. LOCATION avant l\u2019expiration du contrat ou par accord tacite par t\u00e9l\u00e9phone \u00e0 titre exceptionnel. La r\u00e9tention abusive du v\u00e9hicule lou\u00e9 expose le locataire \u00e0 des poursuites et entraine sa d\u00e9ch\u00e9ance du b\u00e9n\u00e9fice du contrat et donc d\u2019assurance. Le locataire est tenu de restituer le v\u00e9hicule comme convenu avec le loueur.<\/p>\n<p><b>ART.4 VERIFICATION A PRECISER<\/b><\/p>\n<p>Pour les locations de longue dur\u00e9e le locataire s\u2019engage \u00e0 pr\u00e9senter le v\u00e9hicule lou\u00e9 \u00e0 PACIFICA. LOCATION pour v\u00e9rification technique gratuite \u00e0 la demande du loueur. Il ne peut s\u2019opposer, si l\u2019immobilisation du v\u00e9hicule lou\u00e9 est n\u00e9cessaire ou d\u00e9passe 15 minutes, \u00e0 son remplacement par un v\u00e9hicule comparable. Le non respect de cette v\u00e9rification technique engage la responsabilit\u00e9 du locataire pour tout dommage survenu en raison d\u2019une d\u00e9faillance technique du v\u00e9hicule.<\/p>\n<p><b>ART.5 PRISE EN CHARGE. RESERVES. <\/b><\/p>\n<p>Le locataire reconna\u00eet avoir pris le v\u00e9hicule lou\u00e9 en parfait \u00e9tat de fonctionnement et d\u2019entretien. Il s\u2019engage \u00e0 signaler sans d\u00e9lai toute d\u00e9fectuosit\u00e9 qu\u2019il pourrait constater, faute de quoi il pourrait \u00eatre tenu responsable, apr\u00e8s expertise, des dommages provoqu\u00e9s par son aggravation.<\/p>\n<p><b>ART.6 PRISE EN CHARGE ACCESSOIRES<\/b>.<\/p>\n<p>Le v\u00e9hicule lou\u00e9 est \u00e9quip\u00e9 de tous ses accessoires en \u00e9tat de fonctionnement. Le locataire est responsable de plein droit de leur disparation ou de leur d\u00e9t\u00e9rioration, et tenu le cas \u00e9ch\u00e9ant \u00e0 leur remplacement au prix courant. Seul le loueur peut donner son accord pour les r\u00e9parations.<\/p>\n<p><b>ART.7 TARIF QUOTIDIEN MINIMUM<\/b>.<\/p>\n<p>La prise en main du v\u00e9hicule comporte un engagement du locataire \u00e0 supporter le tarif quotidien minimum d\u00e9fini au contrat de location, quelle qu\u2019ait \u00e9t\u00e9 la bri\u00e8vet\u00e9 de la prise en charge. Les forfaits sont payables \u00e0 la prise en charge du v\u00e9hicule.<\/p>\n<p>1 journ\u00e9e de location est \u00e9gale \u00e0 24 heures. Au-del\u00e0, un paiement de 1000 xpf sera factur\u00e9 par heure suppl\u00e9mentaire . Au dessus de 3 heures suppl\u00e9mentaires 1 journ\u00e9e compl\u00e8te sera factur\u00e9e<\/p>\n<p>Le Locataire accepte express\u00e9ment que le d\u00e9faut de paiement ou tout impay\u00e9 entra\u00eene la d\u00e9ch\u00e9ance du terme pour les factures non \u00e9chues et la r\u00e9siliation du contrat de plein droit. Dans ce cas le loueur exige la restitution imm\u00e9diate des v\u00e9hicules en cours de location<\/p>\n<p><b>&nbsp;<\/b><b>ART.8 PNEUMATIQUES. <\/b><\/p>\n<p>Ne sont pas inclus dans les tarifs, le remplacement des pneumatiques en cas de crevaison, de jantes tordues, de pneus d\u00e9chir\u00e9s, sauf cas d\u2019usure normal li\u00e9 \u00e0 l\u2019utilisation du v\u00e9hicule. Ces frais feront l\u2019objet d\u2019une facturation compl\u00e9mentaire non inscrits au contrat de location.<\/p>\n<p><b>ART.9 CARBURANT<\/b><b> ET HUILE<\/b><\/p>\n<p>Le carburant est \u00e0 la charge du client qui devra rendre le v\u00e9hicule avec le m\u00eame niveau de carburant constat\u00e9 lors de la remise des clefs avec l\u2019agent de r\u00e9servation PACIFICA. Le locataire doit v\u00e9rifier en permanence les niveaux d&rsquo;huile et d&rsquo;eau. Il devra en cas d&rsquo;insuffisance se rendre au d\u00e9p\u00f4t PACIFICA. LOCATION pour compl\u00e9ter sous peine d&rsquo;avoir \u00e0 payer une indemnit\u00e9 pour usure anormale.<\/p>\n<p><b>ART.10 RAPATRIEMENT DU VEHICULE<\/b><\/p>\n<p>Le locataire s\u2019interdit formellement d\u2019abandonner le v\u00e9hicule. En cas d\u2019impossibilit\u00e9, le v\u00e9hicule sera rapatri\u00e9 aux frais du locataire. La location reste due jusqu\u2019au retour du v\u00e9hicule dans le parc de PACIFICA. LOCATION<\/p>\n<p><b>&nbsp;ART.<\/b><b>11<\/b><b> UTILISATTION ET<\/b> <b>ZONES INTERDITES<\/b><\/p>\n<p>La circulation du v\u00e9hicule est restreinte aux seules \u00eeles de Tahiti et Moorea. Toute utilisation en dehors des voies carrossables de ces deux iles est strictement interdite et exclue de toutes nos garanties, y compris l&rsquo;assurance tous risques. Le non-respect de cette restriction entra\u00eenera imm\u00e9diatement la saisie int\u00e9grale du d\u00e9p\u00f4t de garantie.<\/p>\n<p>La protection d&rsquo;assurance \u00ab\u00a0TOUS RISQUES\u00a0\u00bb ne couvre pas les dommages pouvant survenir, par exemple, dans des lieux tels que la vall\u00e9e de la Maroto ,la vall\u00e9e de la Papenoo, le belv\u00e9d\u00e8re de Pirae et celui de Taravao. Cette \u00e9num\u00e9ration n&rsquo;est pas exhaustive, et toute circulation sur des voies pr\u00e9sentant des risques pour les pneus ou les organes du v\u00e9hicule entra\u00eenera la r\u00e9siliation imm\u00e9diate du contrat de location.<\/p>\n<p>En plus du d\u00e9p\u00f4t de garantie retenu, le locataire assume l&rsquo;enti\u00e8re responsabilit\u00e9 financi\u00e8re des frais li\u00e9s \u00e0 une utilisation inappropri\u00e9e du v\u00e9hicule lou\u00e9, incluant les co\u00fbts de recherche, de rapatriement, de d\u00e9pannage, de remorquage, de gardiennage, d&rsquo;immobilisation (calcul\u00e9 sur la base du tarif journalier de location), d&rsquo;expertise, de remise en \u00e9tat (pi\u00e8ces et main-d\u2019\u0153uvre). De m\u00eame, le locataire est responsable des transferts et de tout dommage mat\u00e9riel ou immat\u00e9riel caus\u00e9 \u00e0 des tiers.<\/p>\n<p><b>ART.12 PROPRETE DU VEHICULE<\/b><\/p>\n<p>Le v\u00e9hicule vous est confi\u00e9 propre. Il devra \u00eatre restitu\u00e9 dans le m\u00eame \u00e9tat de propret\u00e9 auquel cas des frais de lavage de 3000 XPF vous seront factur\u00e9s \u00e0 votre retour. Vous avez la possibilit\u00e9 de r\u00e9gler les frais de lavage au d\u00e9part de votre v\u00e9hicule si vous ne souhaitez pas vous charger du lavage.<\/p>\n<p>Des frais de lavage exceptionnels pour un montant forfaitaire de 10 000 xpf pourront \u00eatre factur\u00e9s en cas non respect des r\u00e8gles de vie \u00e0 bord du v\u00e9hicule : Il est strictement interdit de fumer, consommer des boissons sucr\u00e9s ou alcoolis\u00e9s, transporter des animaux dans votre v\u00e9hicule de location.<\/p>\n<p><b>ART.<\/b>13 <b>RESPONSABILIT\u00c9 EN CAS DE DOMMAGE OU VOL DU VEHICULE<\/b><\/p>\n<p>A)- Responsabilit\u00e9 civile: Le v\u00e9hicule lou\u00e9 est assur\u00e9 pour les dommages que le locataire pourrait causer \u00e0 autrui par accident. Les amendes, cons\u00e9quences de la responsabilit\u00e9 p\u00e9nale du locataire, restent \u00e0 la charge de ce dernier.<\/p>\n<p>&nbsp;B)- En cas de Vol du V\u00e9hicule ou de dommages caus\u00e9s \u00e0 celui-ci par la faute du locataire, ou en l&rsquo;absence de faute d&rsquo;un tiers identifi\u00e9, le locataire devra indemniser PACIFICA Location \u00e0 hauteur du pr\u00e9judice, montant forfaitaire d\u00fb en application du bar\u00e8me pr\u00e9sent\u00e9 au document \u00abforfaits dommage\u00bb&nbsp; cf page 6, ou montant estim\u00e9 par estimation du co\u00fbt des r\u00e9parations, le cas \u00e9ch\u00e9ant, ou valeur v\u00e9nale du v\u00e9hicule en cas de destruction ou vol.<\/p>\n<p><b>ART<\/b><b>.<\/b><b>1<\/b><b>4<\/b> <b>CATEGORIES DE CONDUCTEURS ET CONDITIONS DE <\/b><b>GARANTIE<\/b><\/p>\n<p>Le locataire doit \u00eatre \u00e2g\u00e9 de 25 ans et titulaire du permis de conduire depuis au moins 3 ans r\u00e9volus. Les conducteurs de plus de 70 ans doivent \u00eatre titulaires d\u2019un permis valide.<\/p>\n<p><b>ART.<\/b><b>1<\/b><b>5<\/b> <b>CONSTAT ET RAPPORT D\u2019ACCIDENT<\/b>.<\/p>\n<p>Tout dommage caus\u00e9 au v\u00e9hicule lou\u00e9 doit faire l\u2019objet d\u2019un constat d\u2019accident. Le locataire doit se pr\u00e9senter imm\u00e9diatement et dans un d\u00e9lai maximum de 48h au Bureau de PACIFICA. LOCATION pour y \u00e9tablir le rapport et transmettre le constat. Le locataire qui ne respecte pas cet engagement est tenu responsable financi\u00e8rement des dommages caus\u00e9s et de leurs cons\u00e9quences.<\/p>\n<p><b>&nbsp;ART.<\/b><b>1<\/b><b>6<\/b> <b>EXCLUSION DE GARANTIE <\/b>:<\/p>\n<p>&nbsp;Outre les exclusions vis\u00e9es aux conditions g\u00e9n\u00e9rales la responsabilit\u00e9 civile du locataire est pleinement engag\u00e9e dans les circonstances suivantes: a) Dommages caus\u00e9s intentionnellement, par malveillance ou faute inexcusable. b) Dommages caus\u00e9s en cas notamment de travers\u00e9es de cours d\u2019eau, p\u00e9n\u00e9tration en eau de mer, enlisement, renversement du v\u00e9hicule, circulation sur voie non carrossable, les crevaisons, \u00e9clatement ou d\u00e9chirement de pneumatique. c) Dommages caus\u00e9s lors de la conduite en \u00e9tat d\u2019ivresse manifeste ou apr\u00e8s usage de stup\u00e9fiants ou caus\u00e9s par tout passager les ayant provoqu\u00e9s sous l\u2019empire d\u2019un tel \u00e9tat. d) Dommages caus\u00e9s en cas de vol du v\u00e9hicule lorsque la restitution des cl\u00e9s ne pourra \u00eatre obtenue par PACIFICA. LOCATION e) Dommages caus\u00e9s lorsque la conduite du v\u00e9hicule aura \u00e9t\u00e9 c\u00e9d\u00e9e \u00e0 une tierce personne non d\u00e9sign\u00e9e au contrat de location. f) Dommages occasionn\u00e9s aux bagages, et objets personnels<\/p>\n<p><b>&nbsp;ART.<\/b><b>1<\/b><b>7<\/b> <b>CONTRAVENTIONS<\/b><b>:<\/b><\/p>\n<p>&nbsp;Le locataire demeure seul responsable des amendes, contraventions et proc\u00e8s-verbaux \u00e9tablis contre lui.<\/p>\n<p>&nbsp;<b>ART.<\/b><b>1<\/b><b>8<\/b> <b>JURIDICTIONS. <\/b><\/p>\n<p>Tout litige au pr\u00e9sent contrat sera port\u00e9 devant la juridiction comp\u00e9tente de la Polyn\u00e9sie Fran\u00e7aise.<\/p>\n<p><b>ART<\/b><b>.<\/b><b>1<\/b><b>9<\/b> <b>GEOLOCALISATION<\/b>:<\/p>\n<p>Toutes nos voitures sont munies d&rsquo;un syst\u00e8me de g\u00e9olocalisation<\/p>\n<p><b>ART.20&nbsp; MISE A DISPOSITION DE SIEGES ENFANTS <\/b><\/p>\n<p>PACIFICA pr\u00eate gratuitement, sous r\u00e9serve de disponibilit\u00e9, des si\u00e8ges pour b\u00e9b\u00e9s et enfants, \u00e0 la condition que la demande soit faite lors de la r\u00e9servation. La non-restitution d&rsquo;un si\u00e8ge enfant entra\u00eenera la facturation conform\u00e9ment \u00e0 la grille des \u00a0\u00bb forfaits dommage\u00ab&nbsp; ( cf page 6). Le locataire donne express\u00e9ment l&rsquo;autorisation au loueur d&rsquo;utiliser son moyen de paiement, notamment la carte bancaire, pour r\u00e9gler cette indemnit\u00e9. PACIFICA ne pourra \u00eatre tenu responsable en cas d&rsquo;accident ou de dommage survenant \u00e0 l&rsquo;enfant si celui-ci n&rsquo;est pas correctement install\u00e9 dans un si\u00e8ge fourni par PACIFICA. Il est soulign\u00e9 que le conducteur, en tant que responsable des occupants du v\u00e9hicule, doit veiller \u00e0 la s\u00e9curit\u00e9 de ses passagers, y compris l&rsquo;installation de si\u00e8ges adapt\u00e9s \u00e0 la morphologie de l&rsquo;enfant et au port des ceintures de s\u00e9curit\u00e9. PACIFICA ne peut \u00eatre tenu responsable d&rsquo;un non-respect des r\u00e8gles de s\u00e9curit\u00e9 en vigueur.<\/p>\n<p><b>ART.21&nbsp; ANNULATION ET POLITIQUE DE REMBOURSEMENT <\/b><\/p>\n<p>Les r\u00e9servations d\u00e9j\u00e0 pay\u00e9es et non encore commenc\u00e9es peuvent \u00eatre modifi\u00e9es sans frais sur demande, jusqu&rsquo;\u00e0 48 heures avant la date de d\u00e9part initialement pr\u00e9vue. Alternativement, le montant de la r\u00e9servation peut \u00eatre converti en avoir, ou faire l\u2019objet d\u2019un remboursement aux frais du locataire.<\/p>\n<p>En cas d&rsquo;absence de demande de modification moins de 48 heures avant le d\u00e9part, la location est consid\u00e9r\u00e9e comme due, aucun avoir ne peut \u00eatre \u00e9mis, et aucun remboursement ne sera effectu\u00e9.<\/p>\n<p><b>ART.<\/b><b>22 ASSISTANCE<\/b><\/p>\n<p>Nous offrons un service d&rsquo;assistance d&rsquo;urgence disponible durant la dur\u00e9e de votre location en cas de probl\u00e8me m\u00e9canique ou d&rsquo;accident. Pour joindre l\u2019assistance il vous suffit de composer le num\u00e9ro de t\u00e9l\u00e9phone gratuit indiqu\u00e9 dans votre contrat de location. Des frais de remorquage et de d\u00e9pannage pourront \u00eatres appliqu\u00e9s en cas de panne caus\u00e9e par une utilisation inappropri\u00e9e du v\u00e9hicule.<\/p>\n<p><b>ART.23 RACHAT DE FRANCHISE<\/b><\/p>\n<p>Le locataire a la possibilit\u00e9 de souscrire \u00e0 une option de <b>rachat de franchise<\/b>, moyennant un co\u00fbt suppl\u00e9mentaire de <b>2000 XPF par jour de location de voiture ou de 1000 XPF par jour de location de scooter<\/b>.
